Puente Solar – Terms of Service
Welcome to Puente Solar. These Terms of Service (“Terms”) govern your access to and use of the Puente Solar mobile application and web platform (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Puente Solar Service, you agree to:
- • Be bound by these Terms of Service and our Privacy Policy
- • Comply with all applicable laws and regulations in Cuba
- • Provide accurate and truthful information in your application
- • Use the Service only for its intended purpose (solar panel installation application and system management)
If you are using the Service on behalf of an organization or household, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility & Account Registration
2.1 Eligibility Requirements
To use the Puente Solar Service, you must:
- • Be at least 18 years old
- • Be a resident of Cuba with a valid physical address
- • Have a property suitable for solar panel installation
- • Provide accurate contact information (email, phone number, address)
- • Not have been previously banned from the Puente Solar program
2.2 Account Registration
When creating an account, you agree to:
- • Provide complete and accurate registration information
- • Keep your account credentials (email and password) confidential
- • Notify us immediately of any unauthorized access to your account
- • Accept responsibility for all activities that occur under your account
- • Maintain only one account per household (duplicate accounts may be deleted)
2.3 Account Security
You are solely responsible for maintaining the security of your account. Puente Solar will not be liable for any loss or damage arising from your failure to protect your account credentials.
3. Solar Panel Installation Program
3.1 Application Process
By submitting an application through the Service, you understand that:
- • Submission of an application does NOT guarantee solar panel installation
- • Applications are subject to verification and approval by program administrators
- • False or misleading information may result in disqualification from the program
- • You may be required to submit supporting documentation (medical letters, utility bills, proof of residence)
- • Priority scores are calculated based on medical needs, energy consumption, and quality of life factors
3.2 Installation Terms
If your application is approved for installation, you agree to:
- • Allow authorized technicians access to your property for installation and maintenance
- • Provide a safe working environment for installation technicians
- • Follow all safety guidelines and maintenance instructions provided
- • Not tamper with, modify, or remove installed solar panel equipment without authorization
- • Report any system malfunctions or safety concerns immediately
- • Be available for scheduled installation appointments (failure to respond may result in rescheduling or deprioritization)
3.3 Equipment Ownership
Solar panel equipment installed through the Puente Solar program remains the property of the program until full ownership is transferred according to program terms. Unauthorized removal, modification, or sale of equipment is prohibited and may result in legal action.
3.4 Maintenance & Warranty
You are responsible for performing routine maintenance checks as instructed in the app. Equipment warranty terms will be provided separately at the time of installation. Failure to perform recommended maintenance may void warranty coverage.
4. Priority Scoring & Waitlist
Priority scores are calculated using objective criteria including:
- • Medical equipment dependency and critical health needs
- • Monthly energy consumption and utility costs
- • Household size and dependents
- • Geographic region and grid reliability
- • Quality of life factors
You acknowledge that:
- • Priority scores are calculated algorithmically and may be reviewed by administrators
- • Higher priority scores generally result in earlier installation, but do not guarantee a specific timeline
- • Priority scores may be adjusted if new information becomes available or circumstances change
- • Installation schedules depend on equipment availability, technician capacity, and regional logistics
- • Puente Solar reserves the right to adjust prioritization criteria to ensure fair distribution
5. User Responsibilities
As a user of the Puente Solar Service, you agree to:
- • Provide Accurate Information: All information submitted (contact details, medical equipment usage, energy consumption) must be truthful and accurate
- • Update Your Profile: Keep your contact information current so we can reach you for installation scheduling and emergency alerts
- • Respond to Communications: Respond promptly to messages from program administrators and technicians regarding your application or installation
- • Follow Safety Guidelines: Adhere to all safety instructions provided in the app, especially during power outages and emergencies
- • Perform System Checks: Complete recommended weekly system checks to ensure safe operation of your solar panel equipment
- • Report Issues Promptly: Immediately report any equipment malfunctions, safety hazards, or emergency situations
- • Respect Technicians: Treat installation and maintenance technicians with respect and professionalism
6. Prohibited Uses
You may NOT use the Puente Solar Service to:
- • Submit false, fraudulent, or misleading information to gain unfair priority
- • Create multiple accounts to circumvent the one-account-per-household rule
- • Harass, threaten, or abuse other users, technicians, or program administrators
- • Attempt to hack, reverse engineer, or compromise the security of the Service
- • Use automated tools (bots, scrapers) to access or manipulate the Service
- • Resell, transfer, or sublicense your application or installed equipment without authorization
- • Violate any applicable Cuban laws or regulations
- • Interfere with the proper operation of the Service or other users’ access to it
- • Impersonate another person or entity
- • Upload viruses, malware, or other malicious code
Violation of these prohibited uses may result in immediate account suspension or termination, disqualification from the solar panel program, and potential legal action.
7. User Content & Document Uploads
When you upload documents (medical letters, utility bills, etc.) to the Service, you:
- • Retain ownership of your uploaded content
- • Grant Puente Solar a license to use, store, and process your documents for verification and program administration
- • Represent that you have the right to upload the documents and that they do not violate any third-party rights
- • Agree not to upload documents containing viruses, illegal content, or sensitive information beyond what is required for verification
- • Understand that uploaded documents may be reviewed by program administrators and verification staff
Puente Solar reserves the right to remove any uploaded content that violates these Terms or our content policies.
8. Intellectual Property
The Puente Solar Service, including all content, features, software, designs, logos, and trademarks, is owned by Puente Solar and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to:
- • Access and use the mobile app and web platform for personal, non-commercial purposes
- • Download and view documents and guides provided in the Knowledge Hub for your personal use
You may NOT:
- • Copy, modify, distribute, sell, or create derivative works from the Service
- • Remove any copyright, trademark, or proprietary notices
- • Use the Puente Solar name, logo, or branding without written permission
- • Reverse engineer or decompile the mobile application
9. Disclaimers & Warranties
9.1 Service Availability
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee that:
- • The Service will be uninterrupted, secure, or error-free
- • The Service will be available in all areas of Cuba at all times (especially in areas with limited internet connectivity)
- • Offline features will work perfectly in all scenarios
- • All bugs or errors will be corrected immediately
9.2 Installation Timeline
Puente Solar does NOT guarantee:
- • That your application will be approved
- • A specific installation date or timeline
- • That solar panel equipment will always be available
- • That installed equipment will eliminate all power outages or energy problems
9.3 Third-Party Services
The Service relies on third-party infrastructure (Expo, Uploadcare, Neon Database, etc.). We are not responsible for outages, data loss, or issues caused by third-party service providers.
9.4 Medical Disclaimer
While the priority scoring system considers medical equipment needs, Puente Solar is NOT a medical service. We do not provide medical advice or guarantee that solar panel installation will meet all medical equipment power requirements. Consult with medical professionals regarding backup power needs for critical medical equipment.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUENTE SOLAR SHALL NOT BE LIABLE FOR:
- • Any indirect, incidental, special, consequential, or punitive damages
- • Loss of profits, revenue, data, or business opportunities
- • Damage to property or personal injury resulting from your use of the Service
- • Equipment malfunctions, power outages, or failures of installed solar panel systems
- • Delays in application processing or installation scheduling
- • Errors or inaccuracies in priority score calculations
- • Loss of data due to device failure, internet connectivity issues, or third-party service outages
- • Actions or omissions of installation technicians (who are independent contractors)
- • Damages resulting from unauthorized access to your account due to your failure to protect your credentials
IN NO EVENT SHALL PUENTE SOLAR’S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE (WHICH IS CURRENTLY $0, AS THE SERVICE IS FREE).
11. Indemnification
You agree to indemnify, defend, and hold harmless Puente Solar, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- • Your violation of these Terms of Service
- • Your violation of any applicable laws or regulations
- • Your submission of false or fraudulent information
- • Your misuse of installed solar panel equipment
- • Your violation of third-party rights (including intellectual property rights)
- • Your negligence or willful misconduct
12. Account Termination
12.1 Termination by You
You may terminate your account at any time by:
- • Contacting Puente Solar support to request account deletion
- • Understanding that termination will result in loss of your application status and priority score
- • Acknowledging that if solar panels have been installed, equipment removal terms will apply separately
12.2 Termination by Puente Solar
We reserve the right to suspend or terminate your account immediately, without notice, if:
- • You violate these Terms of Service
- • You provide false or fraudulent information
- • You engage in prohibited activities
- • You fail to respond to installation scheduling after multiple attempts
- • We suspect fraudulent or abusive behavior
- • Required by law or government regulation
- • The solar panel program is discontinued
12.3 Effect of Termination
Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.
13. Modifications to the Service
Puente Solar reserves the right to:
- • Modify, update, or discontinue any feature of the Service at any time
- • Change priority scoring algorithms or eligibility criteria
- • Adjust installation timelines based on equipment availability and program capacity
- • Add or remove geographic regions from the program
- • Update the mobile app or web platform with new features or bug fixes
We will make reasonable efforts to notify you of material changes via email or in-app notifications.
14. Changes to Terms of Service
We may update these Terms of Service from time to time. When we make changes:
- • We will update the “Last Updated” date at the top of this page
- • We will notify you via email or in-app notification of material changes
- • Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms
- • If you do not agree to the revised Terms, you must stop using the Service and may terminate your account
We encourage you to review these Terms periodically.
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute with Puente Solar, please first contact us at the contact information below to attempt to resolve the issue informally.
15.2 Governing Law
These Terms are governed by the laws of Cuba, without regard to conflict of law principles.
15.3 Jurisdiction
Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Cuba, and you consent to the jurisdiction of such courts.
15.4 Arbitration (if applicable)
For certain disputes, Puente Solar may require binding arbitration in accordance with Cuban arbitration procedures. Details will be provided if applicable.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Puente Solar regarding the Service.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
16.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
16.4 Assignment
You may not assign or transfer these Terms or your account to any other person. Puente Solar may assign these Terms to any affiliate or successor entity.
16.5 Force Majeure
Puente Solar is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, power outages, government actions, or equipment shortages.
16.6 Language
These Terms are provided in both English and Spanish for convenience. In the event of any conflict between versions, the English version shall prevail.
